Schedules of Dilapidations

Our team of Chartered Building Surveyors are specialists in dealing with all aspects of dilapidations claims. Lea Hough’s team of Chartered Building Surveyors act for commercial Landlords in preparing a detailed Schedule of Dilapidations on their behalf.

Normally prepared on behalf of the Landlord when a Tenant’s lease on a commercial property is coming to an end (Terminal Schedule of Dilapidations) or during the term (Interim Schedule of Dilapidations), a Schedule of Dilapidations is a report that investigates and documents the condition and state of a repair of a property.

The report will include details of the Tenant’s breaches to the lease, the remedial works and course of action needed to remedy this, together with the costs required in order to bring the building back to the original condition. Where a Schedule of Condition was prepared at the beginning of the lease term, the Schedule of Dilapidations will use this as a reference point.

After a dilapidations report has been produced, the landlord will normally take action by way of a dilapidations claim – often a monetary settlement payable by the Tenant.

Our dilapidations surveyors can negotiate the settlement with the Tenant or the Tenant’s Surveyor. We can also assist with the planning and procurement of the remedial and reinstatement works required.

With the purpose being to ensure that the building is kept in a good state of repair and to ensure that the Landlord suffers no monetary loss due to breaches or actions of the Tenant at the end of, or during the term of the lease, many landlords find our Schedule of Dilapidations services invaluable. Not only can our advice help to reduce or altogether mitigate their liability for the cost of any repair work, when produced far enough in advance, we can help to ensure that all dilapidations works are completed in a timely manner, reducing the need for any undue periods of unoccupancy.

Our Schedules of Dilapidations are prepared in accordance with the current RICS Guidance Note and the PLA Dilapidations Pre-Action Protocol.
